Your visa ends in four months. The plan was a diploma, a student visa lodged from your flat in Footscray, and two more years. Since 2 October 2026 that plan does not exist. A student visa lodged in Australia by a 482, 485, 417, 462, 407, 408, 400 or visitor visa holder is invalid. Not refused. Invalid, as if it was never made.
Short answer: Check the visa you hold today against the offshore list. If it is there, a student visa means leaving Australia first and being outside Australia at grant. If you already hold a student visa, you need one of five exemptions to apply onshore. The main applicant charge is $2,500, and an invalid application does not get it back for you.
The visa you hold decides everything
The Migration Amendment (Student Visa Reform) Regulations 2026 and the instrument LIN 26/102 commenced on 2 October 2026. Together they list the visas whose holders must be outside Australia to lodge a Student visa (subclass 500) or Student Guardian visa (subclass 590).
| Added 2 October 2026 | Already listed |
|---|---|
| 400 Short Stay Specialist | 485 Temporary Graduate |
| 407 Training | 600 Visitor, 601 ETA, 651 eVisitor |
| 408 Temporary Activity | 602 Medical Treatment |
| 417 Working Holiday, 462 Work and Holiday | 771 Transit, 988 Maritime Crew |
| 482 Skills in Demand and Temporary Skill Shortage, 457 | 995 Diplomatic primary holders, 403 Domestic Worker stream |
The Department’s own wording is that an onshore application by a holder of these visas will be invalid. There is no discretion and no review, because no application exists to review.
Pick your visa
You cannot lodge a student visa onshore. If you have left your sponsor, the clock that matters is the 180 day period to find a new one, explained on our 482 page. If the plan was study because sponsorship fell through, the realistic options are a new sponsor, a skilled visa if your points stack up, or leaving to apply for the student visa from overseas.
The 485 was already on the offshore list, so nothing changed on 2 October for you. What changed is the pressure around you: the Opposition has proposed abolishing the 485 entirely, and the Government has closed the onshore student route for everyone else. Use the 485 time for a skills assessment and a sponsor, not for a second course. Our 485 page sets out the timeline.
A second or third year is now a ballot, and the student visa fallback is gone. If you want to stay, the question is whether your trade or degree fits a sponsored role. Construction, healthcare and agriculture are now priority occupations for processing. Our working holiday page covers the ballot and the alternatives.
You can apply onshore only under an exemption: one further course at a higher AQF level, up to 12 more months to finish your current course with the same provider, provider default, a doctoral degree, school studies, or Defence or Foreign Affairs sponsorship. A second course at the same level is not an exemption. Our student visa page has the full list.
Three things that changed for every student
- Family membersCannot be included unless you are a doctoral student, a foreign government scholarship student, Defence or Foreign Affairs sponsored, or a national of a listed Pacific or ASEAN country. A partner or child who already held a student dependant visa on 2 October can be included in your next application. Nobody can add a family member after grant. No exemptions.
- Offshore at grantIf you must apply from outside Australia, you must also be outside Australia when the visa is granted. Flying back early does not work.
- The 28 day pathwayLodging onshore within 28 days of a student visa ending is no longer possible, except where the Tribunal set aside a cancellation after the visa ceased.
What an invalid application costs
An invalid application is not refused, so the charge is not spent on a decision. However, the time you waited is gone, your current visa kept running down, and no bridging visa followed. The ImmiAccount fault that blocked some valid lodgements for course progression, completion and family exemptions has been fixed, so a lodgement that fails now is failing on the rules.
Student visa charge verified against Home Affairs visa pricing as at 1 July 2026. Rules from the Department’s Changes to Student visa application rules factsheet, read 25 October 2026.
Before you pay a course deposit
I lodged before 2 October with my partner included. Are we affected?
No. Applications lodged before the new rules started, including applications with family members, continue to be assessed under the rules in place when they were lodged. Do not withdraw and relodge.
Can I fly to Bali, lodge, and fly back to wait?
You can lodge from outside Australia, but clause 500.411 requires you to be outside Australia when the visa is granted. Returning on another visa while the student visa is pending means it cannot be granted while you are here.
Frequently asked questions
Can a 482 holder apply for a student visa in Australia?
No. Since 2 October 2026 the 482 is on the list of visas whose holders must apply from outside Australia. An onshore application is invalid.
Which current students can still apply onshore?
Those progressing to one further course at a higher AQF level, those needing up to 12 more months to finish the current course with the same provider, provider default cases, doctoral students, school students, and Defence or Foreign Affairs students.
Can I add my partner after my student visa is granted?
No. The subsequent entrant pathway was removed on 2 October 2026 and the Department says there are no exemptions.
Does an invalid application get a refund?
An invalid application is treated as never made. Whether any charge paid can be refunded depends on the Department’s refund rules, and it should not be assumed.
Are applications lodged before 2 October 2026 affected?
No. They are assessed under the rules in force when they were lodged, including any family members in them.
