Cancelled at the Border: What Happened to Zhang, and What to Do in the First Hour

It is 9.40am at Sydney Airport. You have been awake for twenty hours. An officer has opened your bags, found goods worth more than the $900 you ticked no to, and is now reading a document aloud through a telephone interpreter. You will be asked to sign it. What you do in the next hour decides whether your visa survives, and whether a court can help you later.

Short answer: Declare what you carry. If a cancellation starts anyway, ask for a copy of every document and keep it. In Zhang (No 2), decided 16 October 2026, the Court quashed a border cancellation because the notice was shown, signed and taken back within a minute. The wrong answer on the card was a valid ground. The procedure was not.

What happened in Zhang

  1. 3 October 2026A Chinese student visa holder arrives at Sydney Airport. On the incoming passenger card she ticks no to carrying goods worth more than $900.
  2. Baggage checkGoods worth $8,471.95 are found.
  3. InterviewA delegate interviews her with a telephone interpreter. The delegate reads Part A of the notice of intention to consider cancellation aloud for nearly nine minutes without pausing. The interpreter gives a summary.
  4. 10.15amShe signs the notice. The delegate takes it back within a minute. She is never given a copy while she considers her response.
  5. DecisionThe visa is cancelled under section 116(1)(d) of the Migration Act for giving an incorrect answer contrary to section 102.
  6. 16 October 2026Judge Manousaridis quashes the cancellation. Costs of $20,000 against the Minister.

Why she won, and why it was not the goods

She argued the goods question on the passenger card was outside section 102, so a wrong answer could not ground cancellation. The Court disagreed. She argued the weight placed on the wrong answer was irrational. The Court disagreed again. An incorrect answer to the goods question is a lawful basis for cancellation.

What to do in the first hour

Our refusals and review page explains the pathways after a cancellation. If the visa cancelled was a visitor visa, our 600 page covers what a fresh application would need.

Three people this affects

A student arriving with gifts for family

Phones, cosmetics and gifts add up past $900 quickly. Declaring them means duty at worst. Not declaring them is a wrong answer under section 102, and Zhang confirms it can cost a visa.

A 482 worker arriving to start a job

A border cancellation on arrival ends the job before it begins and leaves the sponsor with a nomination and no worker. The procedure point in Zhang applies equally, but the better outcome is never to be in the interview room.

A person already removed

The decision can still be challenged. The record and the audio exist, and a signed acknowledgement does not prove the document was left with you. The time limits are the constraint.

Does the Court’s decision mean she keeps her visa?

The cancellation was quashed, so it has no effect. The Court did not decide whether a fresh, properly conducted process could reach the same result.

Frequently asked questions

Can a wrong answer on the passenger card cancel a visa?

Yes. The Court in Zhang confirmed that an incorrect answer to the goods question is a ground for cancellation under section 116(1)(d).

What does handed to a person personally mean?

Putting the document in the person’s possession or control, or letting them keep it. Showing it for signature and taking it back is not enough.

Is a signed acknowledgement proof I received the notice?

No. The Court looked at what the delegate actually did. The record of interview and the audio decide it.

How long do I have to challenge a border cancellation?

Judicial review time limits are short and run from notification. Get advice within days, not weeks.
